General Terms and Conditions of Sale (GTCS)

1. Seller Identification
This document constitutes the General Terms and Conditions of Sale (GTCS) for works of art by the painter Guillaume Clément Jacques, acting as an artist-author.

2. Purpose
These GTCS define the conditions under which Guillaume Clément Jacques sells his works of art (hereinafter referred to as “the work” or “the works”) to buyers (hereinafter referred to as “the buyer”).
Sales are not conducted online but through direct contact between the buyer and the artist, via email or any other means of communication.
3. Characteristics of the Works
The works sold are original creations by the artist, made on various supports (canvas, paper, wood, etc.).
Each work is unique and may be accompanied by a certificate of authenticity upon request.
4. Pricing and Payment
Prices for the works are available upon request and may vary depending on format, support, and technique used.
Accepted payment methods:
- Bank transfer
- Check (France only)
- Cash (for in-person transactions)
Full payment must be made before shipment or delivery of the work.
5. Delivery and Collection of Works
The shipment of works is carried out according to the terms agreed upon between the artist and the buyer.
Shipping fees:
- Shipping fees are the responsibility of the buyer and will be communicated before finalizing the sale.
- The artist cannot be held responsible for any damage occurring during transport. Insurance can be purchased upon request.
In-person collection:
- Available in Bordeaux and surrounding areas, by appointment.
6. No Right of Withdrawal
In accordance with Article L121-21-8 of the French Consumer Code, the right of withdrawal does not apply to custom or unique works of art.
No order cancellations will be accepted once payment has been made.
7. Intellectual Property
Purchasing a work does not transfer reproduction and representation rights. The artist remains the sole holder of these rights.
Any unauthorized use, reproduction, or distribution is strictly prohibited.
8. Warranties and Liability
- Works are sold as-is. No warranty other than authenticity is provided.
- The buyer is responsible for properly preserving the work after acquisition.
9. Governing Law and Jurisdiction
These GTCS are governed by French law.
In the event of a dispute, the competent courts shall be those within the jurisdiction of Bordeaux.
